Welcome to The Mawa Cake Co. These Terms of Service ("Terms") govern your use of our website and the purchase of products from us. By accessing our website, placing an order, or otherwise engaging with our brand, you agree to be bound by these Terms.
ABOUT US
The Mawa Cake Co. is a Mumbai-based artisanal bakery producing small-batch mawa cakes based on a multi-generational family recipe. We operate from a registered home kitchen in Mahim West, Mumbai, under FSSAI License No: [FSSAI_NUMBER].
ELIGIBILITY
By placing an order, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract.
OUR PRODUCTS
Our products are baked fresh in small batches using traditional methods and high-quality ingredients. As natural ingredients are used, there may be slight variations in appearance, taste, or texture between batches. We do not guarantee uniformity but commit to consistent quality.
ALLERGEN INFORMATION
Our cakes contain dairy (mawa, butter, milk), eggs (in our egg variant), wheat, and sugar. Our products may also contain traces of nuts. If you have any allergies or dietary restrictions, please contact us before ordering. We are not responsible for adverse reactions resulting from undisclosed allergies.
ORDER PROCESS
1. Orders are placed through our website at themawacakeco.com.
2. Payment is collected at the time of order placement via Razorpay.
3. Once payment is confirmed, your order enters our production schedule and cannot be cancelled or modified.
4. Orders placed before our daily cutoff time will be eligible for next-working-day delivery. Orders placed after the cutoff will be scheduled for the following working day.
5. We do not bake or deliver on Mondays.
PRICING
All prices on our website are displayed in Indian Rupees (INR) and include applicable taxes unless otherwise stated. Delivery charges are calculated based on the delivery pincode and shown at checkout.
We reserve the right to change prices at any time without prior notice. Once an order is placed and paid for, the price for that order will not change.
PAYMENT
We accept payments via Razorpay, including UPI, debit/credit cards, net banking, and wallets. All transactions are processed securely. We do not store your payment details on our servers.
DELIVERY
1. We currently deliver only within Mumbai.
2. Delivery is fulfilled by our logistics partner, Borzo.
3. Delivery dates are selected by you at checkout and are based on next-working-day availability.
4. You will receive an SMS with live tracking on the day of delivery.
5. Someone must be available at the delivery address to receive the order. If the delivery cannot be completed due to the recipient being unavailable, we will not be able to reschedule the delivery, and a refund will not be applicable.
ORDER CANCELLATION
Once payment is confirmed and the order has entered production, it cannot be cancelled. Please refer to our Refund Policy for situations in which a refund may be applicable.
QUALITY AND DAMAGE CLAIMS
If your order arrives damaged or has a quality issue, please contact us within 24 hours of delivery with photographs. Claims raised after 24 hours may not be eligible for refund or replacement.
FORCE MAJEURE
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, government restrictions, public health emergencies, transportation disruptions, or acts of our logistics partner.
INTELLECTUAL PROPERTY
All content on our website — including the brand name "The Mawa Cake Co.", logo, design, photography, copy, and product names — is the intellectual property of The Mawa Cake Co. and may not be copied, reproduced, or used without our written permission.
USER CONDUCT
When using our website or interacting with us, you agree not to:
1. Use our website for any unlawful purpose
2. Attempt to gain unauthorised access to our systems
3. Misrepresent your identity or provide false information
4. Engage in abusive, threatening, or harassing communication with our team
LIMITATION OF LIABILITY
To the maximum extent permitted by law, The Mawa Cake Co. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or website. Our total liability for any claim related to a product shall not exceed the amount paid for that specific order.
CHANGES TO TERMS
We may update these Terms from time to time. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.
GOVERNING LAW
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our products shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
